CONTEST RULES: T&C and PRIVACY STATEMENT

 

  1. Terms and conditions

 

Art. 1 Organization

The “Buy Diekirch and get the chance to win a Weber BBQ” is organized by S.A. Brasserie de Luxembourg Mousel-Diekirch, Rue de la Brasserie 2, 9214 Diekirch, hereinafter referred to as "the organizer".

 

 

Art. 2 Brief description of the competition and the prize

 

Short description: When purchasing a Diekirch pack, valid on the full assortment, the consumer, aged 18 or over, will be able to legally participate to get a chance to win a Weber BBQ by scanning the QR code and filling in an online participation form, that includes a tiebreaker question and personal details. The latter will be necessary to contact the potential winner. The winner will be chosen nationally by selecting the consumer who answered the questions correctly and has a valid proof of purchase.

 

The competition will run from 22/04/2024 until 28/06/2024.

 

To be won: BBQ Weber SPIRIT EPX325S PREMIUM GBS.

 

One participant can win maximum one prize.

The prizes will not be transferable, exchangeable or movable and will not be paid in cash under any circumstances. Prizes will not be replaced in the event of loss. The organizer reserves the right to prematurely end this action, to possibly modify the action (or the conditions of the action) or to replace the prize to be won by another prize of an equivalent nature and value.

 

The prize will be sent to the winner as follows: The consumer will be contacted by the organizer using the contact details provided on the participation form so the consumer can pick this up at the brewery.

 

Art. 3 Participation

Any natural person who is at least 18 years old and domiciled in Luxembourg can participate in the competition. The participation of the employees of the organizer and any other person who contributed directly or indirectly to the realization of this competition (such as merchandisers, store owners and their staff, etc.) is excluded. Also excluded: all people who work in collaboration, or who cooperate within the framework of a legal or moral association, or in any other way, in order to increase their chances of success.

 

The same person can only participate once.

 

Any incomplete participation will immediately lead to exclusion from the competition. The data recorded on the entry form may in no case be modified, corrected or adapted.

 

The organizer can, at any time, exclude the participation of a person in the contest during a certain period and this, in the event of violation of one of the conditions of participation or in the event of abuse, deception or fraudulent participation. in the competition.

The use of a program or means other (personalization or editing of the site) than the site program is strictly prohibited and will result in the exclusion of the participant. If so, the latter is liable to prosecution for copyright infringement.

Any attempt at fraud will result in the immediate exclusion of the participant in question.

 

Participation is personal and can in no case be transferred to third parties.

 

 

Art. 4 Determination of the winners

The person who answers both questions correctly has a chance to win the BBQ Weber. The winners will be determined once the contest is over at latest by 28/06/2024. The winner has one week to respond to the organizer. If no response, the organizer can contact a new winner after a week.

 

If the participant's contact details are incorrect or if there is no response in the manner and within the time period specified in these rules, the participant's right to the prize will lapse.

 

The winner is responsible for the use of the prize. It exempts the organizer from any responsibility in this matter.

 

Art. 5 Payment and acceptance

By taking part in the competition, the participant accepts the entire competition rules as well as any decision likely to be taken by the organizer.

 

The organizer is not responsible for damaged, lost or delayed shipments.

 

In the event of a dispute or for any case not provided for by these regulations, the decisions of the organizer will be irrevocable and without appeal.

 

 

Art. 6 Communication

With the exception of the provision of these rules or the notification of the winner, no form of communication, whether physical or electronic, will be made during the course of the competition.

Art. 8 Civil liability

The organizer cannot be held responsible for cases of force majeure or for any reason beyond the control of the organizer requiring the modification, suspension or cancellation of the competition. The organization reserves the right to modify the competition rules should this prove to be essential for organizational reasons or in the event of force majeure. The organizer cannot be held responsible for any damage of any kind whatsoever resulting from participation in the competition or the awarding of the prize. In the event of irregularities, including, but not limited to, errors that occur in the web generator or organizer, the organizer decides autonomously on how the problem is corrected and / or completed. The decision of the organizer cannot be contested.

The printing of errors, spelling mistakes or other errors, technical problems or other problems related to or arising from the competition, cannot be invoked as grounds for any compensation, obligation or liability of the organizer. The organizer cannot be held responsible for technical problems which make it impossible to participate in the competition or which would prevent the continuous and uninterrupted course of the competition.

The organizer cannot be held responsible, in any way, for the bad communication of data which would lead to a bad address or an unknown address of the participant. If a prize (1) does not arrive on time due to loss and / or delay in delivery by the postal services, and / or (2) is intentionally or accidentally damaged by the postal services, the organizer cannot be held responsible. Regarding the possible costs of participation in the competition, there is no recourse against the organizer.

 

 

  1. Privacy and Data Protection

 

Data controller: In accordance with Regulation (EU) 2016/679 - General Data Protection Regulation (GDPR) - we would like to inform the data subjects that the data controller is S.A. Brasserie de Luxembourg Mousel-Diekirch, Rue de la Brasserie 2, 9214 Diekirch, in joint controllership with the participating store as regards the processing activities related to the organization of the contest.

 

Purpose of processing: The purpose of the processing is the execution of the contest (i.e. the management of your participation in the contest, selection of a winner, notifying the winner, delivery of the prize to the winner etc.). Collection of participations, selection of the winner and delivery of the prize will be done by the participating store. Personal data collected will not be shared with Inbev.

 

Categories of personal data: The categories of personal data that will be processed are your identification and contact details: surname, first name, date of birth (to check if you are old enough to participate in the contest), e-mail address and phone number.

 

Legal basis for processing:

You can voluntarily participate in the contest. We process your personal data obtained from such participation based on your consent and will use it only for the purpose of organizing and completing the competition.

 

For any other processing of personal data, we will request your consent separately.

 

Destination of the data: The personal data used for this processing will be collected and stored by the participating store, it will not be transferred to Inbev nor to any other recipient.

 

Rights of the people: Data subjects may exercise the following rights at any time:

              

               a) Right of access: The data subject can obtain confirmation of the personal data processed by the controller.

b) Right of rectification: The data subject has the right to demand the modification of inaccurate or incomplete data.

c) Right to erasure: The data subject may demand that their data not be processed without undue delay, when the consent is revoked or the legal basis for the processing no longer exists.

d) Right to restriction of processing: The data subject has the right to demand the restriction of the processing of his personal data when the conditions set out in Article 18 of the GDPR apply.

e) Right to data portability The data subject may request their personal data and, where appropriate, these must be communicated to them in a structured and accessible format.

f) Right of opposition: The data subject has the right to oppose the processing of personal data concerning him, and the controller will cease all processing, unless he demonstrates the existence of compelling and legitimate reasons for carry out the processing, which outweigh the interests, rights and freedoms of the data subject or the establishment, exercise or defense of legal rights.

g) Right to withdraw consent: the data subject may withdraw their consent at any time without this affecting the legality of the processing prior to the withdrawal.

 

Data subjects can exercise their rights by sending their request to the participating store.

 

Retention period: The personal data concerned by this processing will be stored by the participating store for as long as is necessary for the organization of the contest.

Technical and organizational measures (TOM’s): The controllers will set the technical and organizational measures necessary to guarantee the security of the processing.
